California’s Hands Free Cell Phone Law: What Drivers Need to Know

Irvine Police Sergeant Writing a Ticket to a Driver in a White Car.

California has one of the country’s strictest laws when it comes to using a cell phone behind the wheel. The rule is simple: if you’re driving, your phone must be hands-free.

Drivers are not allowed to hold a phone for any reason while operating a vehicle, whether it’s making a call, sending a text, checking directions, or scrolling through apps. If a device needs to be used, it must be mounted in a secure spot and limited to a single tap or swipe.

Violations can result in costly fines, and repeat offenses may lead to additional points being added to your license. Beyond the penalties, handheld phone use remains one of the leading causes of distracted driving collisions.

Keeping your phone out of your hands is more than a legal requirement. It is a simple step that helps keep everyone on the road safer.
